Welcome, and thanks for being here. These Terms of Use (“Terms”) are the agreement between you and sammymontgoms.com (“we,” “us,” or “our”) covering your use of this website and everything on it, including Cook Club.
Please read them. By using the website, you agree to them. If you do not agree, please do not use the website.
1. Acceptance and Changes
By accessing or using sammymontgoms.com, you agree to these Terms and to our Privacy Policy and Disclosure and Disclaimer, which are part of this agreement.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for significant changes we may provide additional notice. Your continued use of the website after an update means you accept the revised Terms.
2. Who Can Use This Site
You must be at least 13 years old to use this website, and at least 18 (or the age of majority where you live) to purchase a Cook Club membership. If you are between 13 and the age of majority, you may use the site only with the involvement of a parent or guardian.
Please don’t:
- Post anything unlawful, abusive, harassing, hateful, defamatory, or obscene
- Impersonate anyone, or misrepresent your affiliation with a person or organization
- Upload malware, attempt to breach our security, or interfere with the site’s operation
- Scrape, harvest, or use automated tools to extract content from the site (see Section 5)
- Use the site for spam, or to advertise without our permission
- Attempt to access member-only content without a paid membership, or share your login credentials
We may suspend or terminate access for anyone who does any of the above.
3. Your Privacy
Our Privacy Policy explains what we collect and why, and is incorporated into these Terms.
4. Comments and Anything Else You Post
Public content. When you leave a comment, a recipe review, or a rating, you keep ownership of what you wrote. You grant us a non-exclusive, royalty-free, worldwide licence to display, store, reproduce, moderate, and retain that content in connection with operating the website, including displaying recipe ratings on the recipe itself.
You are responsible for what you post, and you confirm that you have the right to post it.
We may edit or remove any comment at our discretion, including comments that are abusive, off-topic, promotional, or spam, and we are not obligated to keep any comment up.
Private messages. If you contact us privately, for example through our contact form, you grant us a limited licence to use that content as reasonably necessary to respond to you, provide support, and operate the website. This licence does not extend to marketing, public display, or derivative works unless you separately agree.
5. Our Content, and What You May Do With It
All recipes, photographs, text, and design on this website are our property unless otherwise noted, and are protected by copyright and other intellectual property laws.
You may share a link to any page, or use one photo with a clear credit and a direct link back to the original post.
You may not republish a full recipe (ingredients plus instructions), copy written content, or use our photos without written permission. If you’d like to feature a recipe, please link to it rather than reproducing it.
No automated collection or AI training. You may not use any automated system, including scrapers, crawlers, bots, or data-mining tools, to collect content from this website, and you may not use our content to train, fine-tune, or develop any machine learning or artificial intelligence system, without our express written permission. This restriction applies whether or not the content is publicly accessible.
6. Third-Party Content and Links
This website displays advertising served by third parties and links to third-party websites. We do not control that content and are not responsible for it. A link or an ad is not an endorsement. See our Disclosure and Disclaimer for more on how the site is monetized.
7. Cook Club Membership
What it is. Cook Club is a paid subscription giving members access to member-only recipes and an ad-free experience on the website.
Billing and auto-renewal. Cook Club is a recurring subscription. Membership is billed in advance on a monthly or annual basis depending on the plan you choose, and it renews automatically at the then-current price until you cancel. The renewal term matches your original term, so monthly plans renew monthly and annual plans renew annually. Current pricing is shown at checkout.
How to cancel. You can cancel at any time through the membership management link in your account or your confirmation email. Cancellation takes effect at the end of your current billing period, and you keep access until then.
Refunds. Because membership gives immediate access to member content, fees are generally non-refundable. If something has gone wrong, contact us. We would rather sort it out than have you feel stuck.
Payment processing. Cook Club is operated through Grocers List, which processes accounts, payments, and subscriptions on our behalf. We never receive or store your full payment card number. Your use of the membership is also subject to Grocers List’s own terms and privacy policy.
Price changes. We may change membership pricing. If we do, we will give you notice before the change takes effect on your renewal, and you may cancel before then if you don’t want to continue.
8. Disclaimers
The website is provided “as is.” We work hard to keep it accurate, useful, and available, but we make no warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
Recipes, allergens, and nutrition. Our Disclosure and Disclaimer page sets out important limitations on our recipes, allergen information, and nutrition estimates. Those disclaimers are part of these Terms. In short: results vary, always check labels yourself if you have an allergy, nutrition figures are estimates, and nothing here is medical or nutritional advice.
9. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of the website, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the website or these Terms will not exceed the greater of (a) one hundred Canadian dollars (CAD $100) or (b) the total amount you paid us in the twelve (12) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the website, your content, or your breach of these Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in it, without regard to conflict-of-law principles.
You agree that any dispute arising out of or relating to these Terms or the website will be brought exclusively in the courts located in Alberta, Canada, and you consent to the jurisdiction of those courts.
Before filing anything, please contact us first. Most problems are faster to fix by just telling us about them.
11. Copyright Complaints
If you believe content on this website infringes your copyright, contact us with: a description of the work, the URL of the allegedly infringing material, your contact information, a statement that you believe in good faith the use is not authorized, and a statement that the information in your notice is accurate.
12. General
If any provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the website. You may not assign these Terms; we may assign them in connection with a sale or transfer of the business.
